The Fax
Preference Service (FPS) is a central opt out register whereby businesses
(and individuals if they wish) can register their choice not to receive
unsolicited sales and marketing faxes. It is a legal requirement that
companies do not send such faxes to numbers registered on the FPS.
The original legislation was introduced in May 1999. It has subsequently been updated and now the relevant legislation is The Privacy and Electronic (EC Directive) Regulations 2003. The Service is primarily aimed at businesses as individuals have protection under the law and should not receive sales and marketing faxes unless they have given prior permission. The term individual includes consumers at the residential addresses, sole traders, and except in Scotland, partnerships. However, if individuals wish to register on the FPS they may do so. When Purchasing or Renting Mailing Lists, Remember... If your company uses fax marketing you are legally obliged to ensure that you do not fax any number which has registered either on the FPS or with you directly, not to receive direct marketing faxes. It is unlawful for someone in business (including charities or other voluntary organisations) to send a fax to anybody, whether a consumer or business, if the recipient has registered with the Fax Preference Service. It is recommended that any mailing lists that you purchase/rent are cleaned via the FPS file. Failure to do so could result in a fine and/or adverse publicity. As responsible professionals, Direct Marketing companies don't want to upset potential customers/clients or waste time and money by faxing unwanted marketing material. |
