The Telephone
Preference Service (TPS) is a central opt out register whereby individuals
can register their wish not to receive unsolicited sales and marketing
telephone calls. It is a legal requirement that companies do not make
such calls to numbers registered on the TPS.
The original legislation was introduced in May 1999. It has subsequently been updated and now the relevant legislation is The Privacy and Electronic (EC Directive) Regulations 2003. The term individual includes consumers at their residential address, sole traders and, except in Scotland, partnerships. Once a number has been registered with the TPS it will become effective in 28 days. Unsolicited sales and marketing voice recorded messages and calls made to mobile phones are also covered by the TPS. When Purchasing or Renting Mailing Lists, Remember... Many of the people who register their preferences with TPS have suffered a bereavement, and they simply want to stop future commercial telephone calls from being made to the deceased. Unwanted, Marketing telephone calls are not welcome in anyone's home. If consumers are not interested in receiving them, the TPS will update their records for Direct Marketing companies to see and adjust their lists as requested. It is recommended that any mailing lists that you purchase/rent are cleaned via the TPS file. Failure to do so could result in a fine and/or adverse publicity. As responsible professionals, Direct Marketing companies don't want to upset potential customers/clients or waste time and money by making unwanted marketing telephone calls. |
